430 Main Street Site Plan Application

Joseph Basralian represented 18 Hackensack LLC in connection with its site plan application for 430 Main Street, which was approved by the City of Hackensack Planning Board.  The existing building was demolished, and will be replaced by a six-story, mixed-use building that will include ground floor retail space and 40 residential units, with workshare space for tenants and on-site parking.  He also represented Brickyard Urban Renewal, LLC in its site plan for 18 East Camden Street, approved by the City of Hackensack Planning Board.  The project is a five-story, 254-unit apartment building with a multi-story parking garage and on-site amenities including a swimming pool and exercise room.

Builders, developers, planners, architects and municipal and county officials are taking existing structures and adapting them in creative and exciting ways to meet the ever-changing needs of our communities.  Local leaders, real estate professionals and urban designers discussed how adaptive re-use is a proven way to re-build and evolve stranded assets

Winne Banta Welcomes Frank Scangarella

Winne Banta Basralian & Kahn, P.C. is pleased to announce that Frank E. Scangarella has joined the firm as Of Counsel, and will be a member of the Public Finance practice.

Scangarella comes to Winne Banta with over 25 years of experience with complex financing mechanisms for real estate transactions and large infrastructure projects, and environmental law. Regarded as a leading expert in infrastructure finance in New Jersey, Scangarella has structured financing programs for the New Jersey Infrastructure Bank (New Jersey’s SRF, formerly known as the New Jersey Environmental Infrastructure Trust) as its Assistant Executive Director and Chief Operating Officer for the past 13 years – such financing programs include the New Jersey Water Bank Construction Loan Program, the Statewide Assistance Loan Program (Superstorm Sandy Infrastructure Loans), and the New Jersey Transportation Bank. Since its inception in 1986, the I-Bank has issued more than $7B in loans funding approximately 1,400 projects benefiting more than 70% of counties, municipalities, utility and sewerage authorities throughout New Jersey.

Scangarella’s prior public sector experience also includes service as Assistant Counsel to Governor Christine Todd Whitman; Director of Legal Affairs at the New Jersey Water Supply Authority; and Deputy Attorney General in the Division of Law providing legal counsel and representation to the New Jersey Department of Environmental Protection.

Vermella Hackensack

Joseph L. Basralian represents the developer of the 19.7-acre tract in Hackensack formerly occupied by The Record, bordered by the Hackensack River and River Street.  The first phase of the development, called Vermella Hackensack, has been approved for 272 residential units with a pool and other amenities.  The second phase has been approved for approximately 13,000 square feet of first-floor retail space and 39 residential units above the retail.  The development will ultimately have a river walk along the Hackensack River and public access to the walkway.  Construction has begun.  It is anticipated that future phases of development will follow in due course.

Winne Banta Files Lawsuit Which May Overturn New Jersey Wine Retail Statutes

A lawsuit was filed on July 3, 2019 by Winne Banta in the United States District Court for the District of New Jersey which may end New Jersey law that prohibits the shipment of wine to consumers by out-of-state retailers.  The suit seeks to overturn New Jersey law that prohibits direct shipments of wine to consumers by out-of-state wine stores, while allowing shipments by in-state retail wine stores.  The plaintiffs are three New Jersey residents who are wine collectors, as well as a wine store in New York.

The suit was brought by Gary S. Redish, Esq. and Michael J. Cohen, Esq. of Winne Banta, Robert Epstein, Esq. of Epstein Cohen Seif & Porter in Indianapolis, and Professor J. Alexander Tanford of Indiana University Law School.  This follows an earlier case which the same team filed and was successful in a lawsuit in Federal Court in New Jersey and the United States Court of Appeals for the Third Circuit which forced New Jersey to adopt new statutes and regulations permitting out-of-state wineries that register with the State of New Jersey to ship wine to New Jersey residents.

If the Plaintiffs prevail in the new case, consumers may be able to bypass their local New Jersey wine stores and buy wine by telephone or via the internet from out of state retailers and have the wine shipped to them via Federal Express, UPS or similar services.

Bergenfield Planning Board

Bruce Rosenberg secured approval from the Bergenfield Planning Board for a new synagogue, Congregation Ohr Ha Torah. The synagogue will provide 267 seats, a social hall and youth study rooms.
